1. What is a Trust? A trust is a relationship whereby assets are held by one party for the benefit of another. A trust is created by a settlor, who transfers some or all of his or her assets to a trustee. The trustee holds that asset for the trust's beneficiaries. 2. What is a Will Trust? A Testamentary or Will Trust is a Trust which arises upon the death of the testator, and which is specified in his or her Will. Testamentary trusts are distinguished from Trusts, which are created during the settlor's lifetime. 3. What is Inheritance Tax? This is a tax on the value of a person’s estate on death and on certain gifts made by an individual during their lifetime. There is an inheritance tax threshold, the amount above which inheritance tax becomes payable. 4. What is Capital Gains Tax? CGT is a tax on capital gains. If when you sell or give away an asset it has increased in value, you may be taxable on the gain (profit).
